GetOnYoga + Sivananda Yoga Vedanta Centres, India
1.1 These Terms and Conditions (“Terms”) govern registrations made by any student or participant (“Student”, “you” or “your”) for Yoga courses, Yoga classes and Yoga retreats (collectively, the “Offerings”) jointly offered by:
1.1.2 Sivananda Yoga Vedanta Dhanwantari Ashram Trust, including its centres and ashrams operating under the name Sivananda Yoga Vedanta Centres, India.
1.1.3 GetOnYoga and Sivananda Yoga Vedanta Dhanwantari Ashram Trust are together referred to as “we”, “us” or “our” in these Terms.
1.2 These Terms apply when you register for any Offering through online platforms operated by or on behalf of GetOnYoga or Sivananda India, including but not limited to getonyoga.com, sivanandayoga.org, sivananda.tv, and any related subdomains and registration pages that may be used from time to time.
1.3 By completing the registration process for any Offering and or by making any payment towards an Offering, you acknowledge that you have read, understood and agreed to be bound by these Terms. You agree that you are entering into these Terms with both GetOnYoga and Sivananda India.
1.4 These Terms are in addition to the following, all of which you are deemed to have read and accepted:
1.4.2 The separate Cancellation and Refund Policy applicable to the relevant Offering.
1.4.3 Any specific Guidelines issued by Sivananda India or the relevant centre or ashram for a particular Offering, which shall form part of these Terms for that Offering.
1.5 If there is any inconsistency, the specific Guidelines for the Offering will apply to conduct and discipline, and these Terms will apply to commercial and legal matters, unless expressly stated otherwise.
2.1 These Terms apply to Offerings jointly run by GetOnYoga and Sivananda India, including:
2.1.2 Online recorded or self paced Yoga courses and Yoga classes.
2.1.3 In person non residential Yoga courses and Yoga classes.
2.1.4 Residential Yoga courses, Yoga classes and Yoga retreats conducted at Sivananda ashrams or centres.
2.1.5 Free, scholarship based, subsidised and fully paid Offerings.
2.2 For the purpose of these Terms:
2.2.2 “Online Platforms” means the websites, portals and learning systems used to promote, register, sell and deliver the Offerings.
3.1 Sivananda India is responsible for:
3.1.2 Providing qualified teachers and facilitators.
3.1.3 Setting eligibility, participation, attendance and completion requirements.
3.1.4 Deciding on the award of any certification or confirmation of completion where applicable.
3.2 GetOnYoga is responsible for:
3.2.2 Facilitating communication and basic support to Students before and during the Offering.
3.2.3 Assisting with marketing and outreach.
3.2.4 Collecting payments on behalf of the organisers, in accordance with the arrangements agreed between GetOnYoga and Sivananda India.
3.3 GetOnYoga does not manage the day to day teaching or on ground administration of Sivananda centres or ashrams and is not responsible for operational decisions taken by Sivananda India.
4.1 You must be at least 18 years of age to register for an Offering. If you are under 18, registration must be completed by, or with the express consent of, a parent or legal guardian.
4.2 You agree to provide complete, accurate and truthful information during registration, including your legal name, contact information, emergency contact details and any health information requested.
4.3 GetOnYoga and or Sivananda India may:
4.3.2 Request further information or documentation.
4.3.3 Cancel your registration if any information is found to be false, misleading or incomplete.
4.4 Certain Offerings may specify additional eligibility criteria such as prior Yoga experience, previous completion of specific courses or medical fitness. You are responsible for reviewing and meeting those criteria before registering.
5.1 Yoga and related practices involve physical, mental and emotional effort. By registering, you confirm that you have considered your medical condition and are fit to participate, and that you will seek medical advice where appropriate.
5.2 You agree to inform the organisers and teachers of any existing medical conditions, injuries, physical limitations, pregnancy or mental health concerns that may affect your ability to participate safely.
5.3 The Offerings are not a substitute for medical treatment or therapy. No medical advice is being given by GetOnYoga, Sivananda India or the teachers.
5.4 You agree to practise within your own limits, follow instructions carefully and stop any practice that causes pain, discomfort, dizziness or distress and inform the teacher or appropriate representative.
6.1 Where an Offering is chargeable, the fee structure for that Offering, including any applicable taxes, service charges, accommodation charges or other costs, will be displayed on the relevant registration page or otherwise communicated to you before payment.
6.2 By proceeding with payment, you authorise GetOnYoga and or its payment partners to charge the selected payment method for the displayed amount.
6.3 Fees are usually quoted in the currency specified on the registration page and must be paid in that currency, unless otherwise specifically allowed. Any bank charges or currency conversion costs are your responsibility.
6.4 Refunds and cancellations:
6.4.2 By registering, you confirm that you have read and accepted the Cancellation and Refund Policy and understand that certain components, such as booking fees or service fees, may be fully or partly non refundable.
6.4.3 If an Offering is cancelled by GetOnYoga or Sivananda India, refunds or transfers, if any, will be handled as described in the applicable Cancellation and Refund Policy.
6.5 Taxes, including GST or similar taxes, will be charged and collected in accordance with applicable law.
7.1 Timings, dates, teachers, venues and the mode of delivery for an Offering may be adjusted for valid reasons such as operational needs, teacher availability, regulations or events beyond reasonable control.
7.2 GetOnYoga and or Sivananda India may:
7.2.2 Substitute teachers or facilitators.
7.2.3 Modify the timetable or curriculum where reasonably required.
7.2.4 Shift a residential or in person Offering to online mode partially or fully if necessary.
7.3 Such changes by themselves will not automatically entitle you to a refund unless the applicable Cancellation and Refund Policy or a written communication for that Offering states otherwise.
7.4 Neither GetOnYoga nor Sivananda India are responsible for delays or changes caused by events beyond reasonable control, such as natural disasters, pandemics, government restrictions, strikes or failures of internet or communication systems.
8.1 You agree to conduct yourself respectfully towards teachers, staff and other Students and to support a safe and conducive learning environment.
8.2 For residential and in person Offerings, you agree to follow the Guidelines issued by Sivananda India or the hosting centre or ashram. These may include requirements regarding dress, diet, attendance, silence, use of devices and other matters.
8.3 For online Offerings, you agree to maintain decorum on video and audio, avoid disruptive behaviour and follow any online etiquette Guidelines shared for that Offering.
8.4 The detailed Guidelines for centres, ashrams and online conduct shall be shared separately on a course to course basis and may be updated from time to time with reasonable notice. Breach of these Guidelines may result in your removal from the Offering without refund, at the discretion of Sivananda India and or GetOnYoga.
9.1 Attendance is an essential part of all Offerings. You are expected to attend the required number of sessions and to participate sincerely and consistently in practice and study.
9.2 Some Offerings are designed for self practice and learning only and do not lead to a certificate. Others may specify that a certificate of participation or completion will be issued on meeting the stated conditions.
9.3 Certification will be provided only for those Offerings where it is explicitly mentioned in the Offering description or official communication. Certification is not automatic and is subject to the criteria laid down by Sivananda India, which may include attendance, participation, conduct and completion of any assignments or assessments.
9.4 Decisions regarding attendance requirements, completion status and certification are taken by Sivananda India or the designated authority for the Offering and are final.
10.2 By registering, you receive a limited, non exclusive and non transferable licence to use the Learning Materials solely for your personal study and practice. You shall not copy, reproduce, distribute, publish, sell, share or otherwise exploit the Learning Materials for commercial or teaching purposes without prior written permission.
10.3 Access to Learning Materials provided through Online Platforms is not permanent. Unless expressly stated otherwise in the Offering description or your registration confirmation, Learning Materials and recordings will be accessible only for a predefined duration notified for that Offering, after which access may be removed.
10.4 Nothing in these Terms is intended to take away or limit the personal rights of individual teachers in their name, likeness, independent teaching style or any pre existing materials they may own. Any specific arrangement regarding ownership or use of teacher created content will be governed by separate agreements between the teacher and Sivananda India and or GetOnYoga. For the avoidance of doubt, nothing in this clause affects your limited personal licence to access Learning Materials during the applicable access period notified to you.
10.5 Use of the names, logos and marks of Sivananda Yoga Vedanta Centres, India or GetOnYoga by Students is not permitted except where explicitly authorised in writing.
11.1 During certain Offerings, especially residential and in person Offerings, Sivananda India or GetOnYoga may take photographs, audio or video recordings for internal documentation or promotional purposes.
11.2 By participating, you consent to the use of your image, voice and likeness in such material, without payment, in publications and media relating to Sivananda India and or GetOnYoga, unless you opt out in writing before the Offering begins or as per the process notified to you.
11.3 You are not permitted to record, screenshot or share classes or other Students without explicit permission.
12.1 For online Offerings, you are responsible for having a suitable device, internet connection and environment to participate in sessions.
12.2 While GetOnYoga will make reasonable efforts to keep the Online Platforms available, uninterrupted access cannot be guaranteed. Outages or issues caused by third party services, network providers or events beyond reasonable control may occur.
12.3 Access to online components of an Offering, including live sessions and recordings, will be provided only for the duration notified for that Offering. Access may be withdrawn once that period expires.
13.1 To the maximum extent allowed by law, GetOnYoga, Sivananda India and their trustees, directors, employees, teachers and agents will not be liable for any indirect, incidental, special, consequential or punitive damages or for any loss of income, data or opportunity arising out of your participation in an Offering.
13.2 In all cases, the total aggregate liability of GetOnYoga and Sivananda India together in respect of any Offering shall not exceed the total fee actually paid by you for that Offering.
13.3 Nothing in these Terms is intended to exclude or limit any rights you may have under applicable consumer protection laws that cannot be excluded or limited by contract.
14.1 You agree to indemnify and hold harmless GetOnYoga, Sivananda India and their respective entities, officers, employees and teachers from and against any reasonable and direct losses, damages, liabilities, costs and expenses arising from your breach of these Terms, of applicable Guidelines, or of any law in connection with your participation in the Offering.
15.1 By registering, you consent to the collection, storage and use of your personal data by GetOnYoga and Sivananda India for the purposes of registration, administration of the Offering, certification and related communication.
15.2 GetOnYoga and Sivananda India will process your personal data in accordance with applicable data protection laws and their respective privacy policies.
15.3 You may receive communications relating to the Offering and information about related Offerings. You may opt out of non essential marketing communications as provided in those policies.
16.1 Severability – If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16.2 No waiver – Any failure or delay by GetOnYoga or Sivananda India to exercise any right or remedy under these Terms shall not constitute a waiver of that right or remedy, and no waiver shall be effective unless given in writing.
16.3 Assignment – You shall not assign or transfer your rights or obligations under these Terms without prior written consent. GetOnYoga and Sivananda India may assign their rights and obligations to an affiliated entity or successor in interest in connection with a reorganisation or transfer of business, provided that your rights are not materially prejudiced.
16.4 Entire agreement – These Terms, together with the applicable Guidelines and the relevant Cancellation and Refund Policy, constitute the entire agreement between you, GetOnYoga and Sivananda India in relation to the Offering and supersede any prior written or oral understandings relating to the same subject matter.
17.1 These Terms are governed by the laws of India.
17.2 Any disputes arising out of or in connection with these Terms or your participation in an Offering will be subject to the exclusive jurisdiction of the competent courts in Kerala, India, subject to applicable consumer protection laws.
18.1 GetOnYoga and Sivananda India may update or modify these Terms from time to time. The version in force at the time you register for an Offering will normally apply to that Offering unless a change is required by law or regulatory requirement.
